On 13 August 2026 the Board of Directors approved conducting the 2026 election <strong>by mail<\/strong>, as Article 6, Section 2 of the <a href=\"https:\/\/klamathid.org\/wp-content\/uploads\/2018\/11\/KID-Bylaws-Amended-August-14-2017.pdf\" target=\"_blank\" rel=\"noopener\">District's Bylaws<\/a> and ORS 545.163 allow.<\/p>\n    <\/header>\n\n    <div class=\"kid-elect__banner\">\n      <span class=\"kid-elect__banner-label\">Election Day<\/span>\n      <span class=\"kid-elect__banner-date\">Tuesday, 10 November 2026<\/span>\n      <span class=\"kid-elect__banner-note\">Ballots must be received by the District no later than 8:00 p.m.<\/span>\n    <\/div>\n\n    <section class=\"kid-elect__block\">\n      <h2 class=\"kid-elect__h2\">Why this matters<\/h2>\n      <p>Klamath Irrigation District is a special government district organized under <a href=\"https:\/\/www.oregonlegislature.gov\/bills_laws\/ors\/ors545.html\" target=\"_blank\" rel=\"noopener\">Oregon Revised Statutes Chapter 545<\/a>, governed by <a href=\"https:\/\/klamathid.org\/home\/our-team\/\" target=\"_blank\" rel=\"noopener\">five directors<\/a> elected by the landowners the District serves \u2014 one from each division. Those five people set the budget, set assessment rates, hire the District Manager, and direct the District's policy position in every proceeding that touches your water.<\/p>\n      <p>How the District is run, and how patrons take part, is set out on the <a href=\"https:\/\/klamathid.org\/home\/home\/district-governance-accountability\/\" target=\"_blank\" rel=\"noopener\">District Governance & Accountability<\/a> page \u2014 the water rights and legal framework the District operates under, the <a href=\"https:\/\/klamathid.org\/home\/home\/district-governance-accountability\/governance\/\" target=\"_blank\" rel=\"noopener\">Bylaws and governance documents<\/a>, the <a href=\"https:\/\/klamathid.org\/home\/home\/district-governance-accountability\/kid-board-of-directors-meetings\/\" target=\"_blank\" rel=\"noopener\">board meeting agendas and minutes<\/a>, and the budget and audits.<\/p>\n    <\/section>\n\n    <section class=\"kid-elect__block\">\n      <h2 class=\"kid-elect__h2\">Dates to put on the calendar<\/h2>\n      <table class=\"kid-elect__table\">\n        <tbody>\n          <tr>\n            <td class=\"kid-elect__date\">27 Aug 2026<\/td>\n            <td>Nomination filing period <strong>opens<\/strong>. A candidate not nominated by this date cannot be elected.<\/td>\n          <\/tr>\n          <tr>\n            <td class=\"kid-elect__date\">20 Oct 2026<\/td>\n            <td><strong>Voter registration deadline.<\/strong> A completed District Elector Registration Form must be delivered to the District office at least 21 days before the election.<\/td>\n          <\/tr>\n          <tr>\n            <td class=\"kid-elect__date\">10 Nov 2026<\/td>\n            <td><strong>Election Day.<\/strong> Voted ballots must be received at the District office by 8:00 p.m. Postmarks do not count.<\/td>\n          <\/tr>\n        <\/tbody>\n      <\/table>\n      <p class=\"kid-elect__fineprint\">Dates are calculated from the statutory election date under <a href=\"https:\/\/oregon.public.law\/statutes\/ors_545.135\" target=\"_blank\" rel=\"noopener\">ORS 545.135<\/a> and the deadlines in <a href=\"https:\/\/oregon.public.law\/statutes\/ors_545.137\" target=\"_blank\" rel=\"noopener\">ORS 545.137<\/a> and the District's Election Procedures. <!-- EDIT ME: confirm each date with the Election Official and counsel before this insert goes to print. --><\/p>\n    <\/section>\n\n    <div class=\"kid-elect__cols\">\n\n      <section class=\"kid-elect__block kid-elect__col\">\n        <h2 class=\"kid-elect__h2\">Can you vote?<\/h2>\n        <p>District elections are not the same as county, state, and federal elections. <strong>Being registered with Klamath County does not register you to vote with K.I.D.<\/strong> You must register separately with the District, and that registration then stays in effect until your ownership changes.<\/p>\n        <p>You are an elector of the District if you are 18 or older and you own \u2014 or are the purchaser under a recorded contract of purchase for \u2014 land inside the District that is subject to District charges or assessments. <strong>This holds whether or not you live in the District, or even in Oregon<\/strong> \u2014 the statutory definition of an elector reaches every qualifying owner \"whether a resident of the district or state or not\" (<a href=\"https:\/\/oregon.public.law\/statutes\/ors_545.002\" target=\"_blank\" rel=\"noopener\">ORS 545.002<\/a>, carried into Article 5, Section 1 of the <a href=\"https:\/\/klamathid.org\/wp-content\/uploads\/2018\/11\/KID-Bylaws-Amended-August-14-2017.pdf\" target=\"_blank\" rel=\"noopener\">District's Bylaws<\/a>). Note that the rule for <em>directors<\/em> is different: a candidate must be an Oregon resident. Corporations, partnerships, LLCs, trusts, and estates that hold qualifying land vote through a designated representative.<\/p>\n        <p>Votes are weighted by acreage: <strong>one vote below 40 acres, two votes from 40 acres through 160, and three votes above 160.<\/strong> The District counts exactly 40 acres as two votes. The count is based on all of your eligible acreage anywhere in the District, not only the acreage in the division where you vote. When your registration is certified, the Election Official records how many votes you may cast and which division you vote in.<\/p>\n        <!-- NOTE: Article 5.3 of the Bylaws and ORS 545.007(1)(e) place exactly 40 acres in two tiers at once (\"up to 40\" and \"40 acres or more\"). Per the District Elections Officer, KID practice is 0.01-39.99 acres = 1 vote, 40.00 acres = 2 votes. The wording above states that practice. Recommend the Board adopt this as a written rule under ORS 545.221 so it is not left to practice alone. -->\n        <p>Where land is held jointly \u2014 spouses, tenants in common, or any other multiple ownership \u2014 <strong>one vote is allowed for the ownership<\/strong>, cast by any one of the owners. Voting by proxy is not allowed in irrigation district elections.<\/p>\n      <\/section>\n\n      <section class=\"kid-elect__block kid-elect__col\">\n        <h2 class=\"kid-elect__h2\">How to register to vote<\/h2>\n        <p>This is how you register to <em>vote<\/em>. It is a separate process from filing to run for a director seat \u2014 see \u201cThinking about running?\u201d below for that. Registering to vote does not put your name on the ballot, and filing for office does not register you to vote.<\/p>\n        <p>Pick up a blank Elector Registration Form at the District office, then return it completed \u2014 in person or by mail \u2014 with:<\/p>\n        <ul class=\"kid-elect__list\">\n          <li>Your full legal name, mailing address, and date of birth<\/li>\n          <li>Your street address, if you live inside the District<\/li>\n          <li>A legible copy of the deed or contract of sale for each parcel you own inside the District<\/li>\n          <li>The assessor's tax lot number for each parcel<\/li>\n          <li>For an entity or trust: the resolution, bylaws, operating agreement, or certification of trust showing who is authorized to vote<\/li>\n        <\/ul>\n        <p><strong>The form must reach the office by 20 October, not merely be postmarked by then.<\/strong> Section III.B of the Election Procedures requires a completed form to be delivered to the District's business office not less than 21 days before the election. Mail is delivery, but the clock runs on arrival \u2014 if you are close to the deadline, bring it in.<\/p>\n        <p>If you own land in more than one division and live in one of them, you vote in the division where you live. If you own in more than one division and do not live in the District, you choose one division to vote in and file that choice with the Secretary of the Board. <strong>That choice is permanent:<\/strong> under <a href=\"https:\/\/oregon.public.law\/statutes\/ors_545.207\" target=\"_blank\" rel=\"noopener\">ORS 545.207<\/a> it stands until your ownership status changes in any way, or until you become a resident owner.<\/p>\n        <!-- EDIT ME: DISCREPANCY, for Nathan. The text above follows the statute, which controls. -->\n        <p class=\"kid-elect__callout\"><strong>Forms are not available online.<\/strong> The Elector Registration Form is picked up in person at the District office from the District Elections Officer, Cherrese Wilson. Election Procedures<\/a> \u00b7 <a href=\"https:\/\/klamathid.org\/wp-content\/uploads\/2018\/11\/KID-Bylaws-Amended-August-14-2017.pdf\" target=\"_blank\" rel=\"noopener\">K.I.D. Bylaws (amended 14 August 2017)<\/a><\/p>\n      <\/section>\n\n    <\/div>\n\n    <section class=\"kid-elect__block kid-elect__block--rule\">\n      <h2 class=\"kid-elect__h2\">Thinking about running?<\/h2>\n      <p>To serve as a director you must be a resident of Oregon and a bona fide owner \u2014 or a shareholder of a corporate owner \u2014 of land within the division you would represent. Directors serve three-year terms beginning at the annual organizational meeting in January.<\/p>\n      <!-- EDIT ME \/ EDITORIAL NOTE: this sentence restates ORS 545.043 and is accurate as written. It deliberately does NOT state that a candidate may live outside the division (or outside the District) so long as they own qualifying land in the division, which is what the statute permits. Per Gene, the page will not promote non-resident candidacies. Silence here is fine; refusing a nomination on division-residency grounds is not -- ORS 545.043 sets the qualifications and the District cannot add to them. Staff answering at the counter must answer accurately if asked. -->\n      <p>Nominations are made one of two ways: by <strong>petition signed by at least ten electors<\/strong> (<a href=\"https:\/\/oregon.public.law\/statutes\/ors_545.041\" target=\"_blank\" rel=\"noopener\">ORS 545.041<\/a>) qualified to vote in that division, or at an <strong>assembly of not fewer than 25 electors<\/strong>. Not more than one elector of a multiple ownership may sign a petition or vote at an assembly. Completed nominations go to the Secretary of the Board.<\/p>\n      <p><strong>Petitions are notarized by the District Elections Officer<\/strong>, who validates that every signature belongs to an elector registered to vote in that division, and who checks the one-signature-per-multiple-ownership limit against the District's own assessment roll. Both checks are done at the District office \u2014 the County keeps no record of who is registered to vote with K.I.D. Plan around this: a supporter who is eligible but has not registered with the District does not count toward the ten. Because petitions are due <strong>6 October<\/strong> while registration runs to 20 October, your signers need to be registered <strong>before you submit the petition<\/strong>, not merely before the election.<\/p>\n      <!-- DECIDED 14 Aug 2026 (Gene): ORS 545.137(3) supersedes the county-assessor step in ORS 545.041(2)(b)-(c) for regular elections. The District Elections Officer verifies the one-elector-per-multiple-ownership limit against the DISTRICT assessment roll; no county assessor confirmation is obtained. Rationale: 545.041 is the ORGANIZATION election statute, written for the moment before a district exists, which is why the county assessor and county clerk perform every step in it; 545.137(3) carries the nomination MANNER forward but redirects filing to the secretary of the board, and the District now holds the records both checks require. Election Procedures Sec. III.C already contemplates the Elections Officer working from the District assessment roll. TO DO: (1) have Nathan confirm and put it in writing before 27 August; (2) write the rule into the amended Election Procedures under ORS 545.221 so it is a documented District rule rather than practice; (3) if a nomination is later challenged for want of an assessor confirmation, this note and the adopted rule are the record of the District's reasoning and the date it was decided. -->\n      <p><strong>You must be registered to vote in the division you are running to represent.<\/strong> If you are not sure which division your registration sits in, ask the Elections Officer before the filing window closes \u2014 under ORS 545.207 your voting division follows where you live, or the permanent choice you filed as a nonresident.<\/p>\n      <!-- EDIT ME: FOR NATHAN, BEFORE 27 AUGUST. This states District practice as given by the Elections Officer. It is not in ORS 545.043, which sets director qualifications as (1) Oregon residency and (2) ownership of land in the division -- not registration in the division. District employees cannot give legal advice to a candidate, so questions about eligibility or signature validity should go to your own attorney.<\/p>\n      <p>One more thing worth knowing: <strong>if only one qualified candidate is nominated for a seat, no election is held for it.<\/strong> The Board declares that candidate elected. Seats have gone unfilled and uncontested in this Basin before.
