  1. Review of the Agenda

Approve the agenda; add or reorder items as needed by the Board.

  1. Review of the Lawfulness of Reclamation’s May 22, 2026 Letter
  • Bureau of Reclamation “2026 Water Operations Management” directive imposing apportionment volumes, per-acre duties, and diversion-rate caps, with a 5:00 p.m. May 27, 2026 compliance deadline.
  • Consistency of the directive with Commissioner Cameron’s May 18, 2026 correspondence and the District’s contractual delivery obligations.
  1. Oregon Water Law, Contract, and Policy Review
  • Oregon prior-appropriation doctrine and Section 8 of the Reclamation Act (43 U.S.C. § 383); protection of senior Van Brimmer and Henley Ankeny rights.
  • 1954 Operations Contract — Articles 13(a) (delivery), 13(f) (Secretary notification), 26 (shortage/exculpation), and 33; absence of any inter-district apportionment authority binding the District.
  • District policy implications and consistency of any response with the District’s ongoing litigation posture.
  1. District Insurance Policy Review
  • Review of applicable coverage in connection with potential claims, directives, and liability exposure arising from 2026 water operations.
  1. Executive Session — Legal Guidance

Pursuant to ORS 192.660(2)(e), (f), (h), (i), and (n).

Statutory authorizations:

ORS 192.660(2)(h) — To consult with legal counsel concerning the legal rights and duties of the District with regard to current litigation and litigation likely to be filed (Klamath Project water-rights and contract delivery matters).

ORS 192.660(2)(f) — To consider information and records exempt by law from public inspection, including attorney-client privileged communications and litigation materials.

ORS 192.660(2)(e) — To conduct deliberations with persons designated to negotiate real property transactions, to the extent such matters arise.

ORS 192.660(2)(i) — To review and evaluate employment-related performance of a public officer, employee, or staff member who does not request an open hearing, to the extent such matters arise.

ORS 192.660(2)(n) — To discuss information about review or approval of programs relating to the security of the District’s water conveyance, telecommunication, and data-transmission systems and facilities.

All decisions must be made in open session. No final action may be taken in Executive Session (ORS 192.660(6)).

  • Consider and act upon budget adjustments for the District’s 2026 special drought programs.

  • Consider and act upon any policy adjustments arising from the Board’s review and legal guidance.
